by Nilesh Patel

Since April 2005, the Upper Midwest Pension Rights Project has provided free legal assistance to 320 clients and recovered $640,345.00 in pension benefits for individuals throughout Wisconsin, Minnesota, Iowa, and the Dakotas

Since April 2005, the Upper Midwest Pension Rights Project (UMPRP) has provided free legal assistance to 320 clients and recovered $640,345.00 in pension benefits for individuals in a five state region. UMPRP is a joint project of the Minnesota Senior Federation (MSF), the Coalition of Wisconsin Aging Groups’ (CWAG) Elder Law Center, and Iowa Legal Aid. UMPRP is funded by grants from the Administration on Aging and the Retirement Research Foundation. The project offers free legal assistance for residents of Wisconsin, Minnesota, Iowa and North and South Dakota regardless of income or age.

“We are very pleased with the growing number of individuals the project is serving,” states Helen Marks Dicks, Director of CWAG’s Elder Law Center. Ms. Dicks states that UMPRP is a key resource for retirees who have questions on how to locate their pension plan, want to contest a benefits denial, or need assistance with an inaccurate benefits payment.

Two other groups served by UMPRP include widows and divorcees. “Many widows depend on their spouse’s pension to remain financially independent,” states Wisconsin Project Coordinator Nilesh Patel. Patel further states that UMPRP provides the means for widows to continue receiving benefits that have been wrongfully denied. In addition, UMPRP can counsel divorcees on how to protect their rights to their spouse’s pension benefits.

Some recent examples of UMPRP's services include:

1. Filing an appeal for benefits for a widow who was wrongfully denied benefits. A successful appeal will result in the individual receiving back payments going back to 1988.

2. Establishing the right to pension benefits for a former City of Milwaukee worker.

3. Assisting a divorced individual prove that his pension plan administrator had incorrectly divided his benefit.

UMPRP has offices in Madison, WI; St. Paul, MIN; and Des Moines, IA. The offices can be reached via the following toll free numbers: (800) 488-2596 (Madison), (877) 645-0261 (St. Paul), and (800) 992-8161 (Des Moines).
